Abstract

The progress of a company really depends on improving the performance of its employees. Apart from employees, to become a growing and superior company it needs leaders who can organize and carry out company plans to achieve its goals. There are many cases of However, some companies can carry out Termination of Employment (PHK) without distributing severance pay to affected workers. For example, PT Roatex Indonesia Toll System (RITS) carried out layoffs without providing severance pay to its employees. In this article, we use legal research methods through an empirical juridical approach. Termination of employment has been regulated in Perpu No. 2 of 2022, which stipulates that companies cannot carry out layoffs under certain conditions. Apart from that, there are regulations that regulate the amount of severance pay for employees who experience layoffs, namely Perppu Number 2 of 2022 concerning Job Creation.
