Abstract

The recent adoption of Directive 2016/343/EU was a highly significant milestone on the road to setting common standards for strengthening mutual trust among Member States in criminal proceedings. Given the existing level of protection within the European Union, this article analyses in detail the most relevant issues concerning the Directive in order to clarify if and how the protection of fundamental rights has been improved. In particular, this paper focuses on the particularly laborious and much-discussed process of adoption of the Directive, its scope of application and, finally, its basic content relating to the presumption of innocence.
