Abstract

Portugal was the second European Union country to implement the Council Framework Decision on the European Arrest Warrant, a regime which entered into force on 1 January, the 1st 2004. The article focuses on those areas where the Framework Decision allowed, or demanded that choices be made by each national legislator and on the Portuguese responses.
