Abstract

The development of federal trademark dilution laws over the past decade is unusual, perhaps even unique, among the various intellectual property regimes. What is notable about the evolution of this form of trademark protection is the relative balance of power between Congress and the courts as these two bodies have expanded and contracted the scope of protection, respectively, for famous marks.
