Russian Abstract: В статье рассматривается тенденции зарождения сравнительного уголовного права, определяются основные проблемы проявившиеся в период возникновения сравнительного уголовного права в различных правовых системах, формируется представление о подходах к сравнительному уголовному праву на первом этапе его существования.English Abstract: The article examines the origin trends of comparative criminal law in Europe and US, determines the main problems which appeared during the foundation of comparative criminal law in the various legal systems to form a view about the approaches to comparative criminal law at the first stage of its existence.
