Abstract

The article refers to the analysis of the articles of the previous and current edition of the Criminal Codes of the Republic of Armenia, which criminalize evidence falsification in civil, administrative or criminal cases or administrative proceedings. The article, in particular, is aimed at the study of the origin of the legislation establishing criminal responsibility for falsifying evidence and the history of its development, the research and analysis of the problems that arose in the application of the given articles, the study of the contradictory approaches to its application. Falsifying, changing, destroying or hiding evidence, explanations or judicial documents or data or objects obtained as a result of an operative-investigative measure or presenting false evidence as a crime under the new edition of the RA Criminal Code is a novelty, does not have a broad practical experience of application, is full of various problematic formulations, which were raised and researched, as a result of which the author came up with recommendations on making legislative changes in Article 479 of the RA Criminal Code.
