Abstract

This chapter provides an analysis of the concept of the Living Will, and its relationship with the Italian law and the ability of self-determination of the person, the role of consent, as provided in Italian law in relation to fundamental choices of a person and, the impact of the capacity of supervision entrusted with the Italian Constitution when the protection of the human person and its fundamental rights are at risk. It highlights that the Italian legal system already holds adequate means, structures and precedents to treat cases when a patient's consent or refusal to medical treatments are upheld. Following the application of Article 1 of Calabro draft law, an important consequence is that advance treatment directives cannot be used to legitimately request and/or obtain the means to practice euthanasia.
