Abstract

This review essay of Lawrence Lessig's The Future of Ideas and Siva Vaidhyanathan's Copyrights and Copywrongs highlights the common themes in the two books and demonstrates how they represent together a current critique of copyright law in specific and intellectual property more broadly. The author summarizes the principal arguments in the books, situates them in post-Cold War politics, and suggests that both books ignore the important questions of distributive justice raised by intellectual property. After laying out his general critique of the two books, the author turns to a point by point analysis of Professor Lessig's reform proposals.
