Abstract

In the Marine I case, the Committee Against Torture provides direction as regards the question of determining responsibility for safeguarding the human rights of migrants intercepted or rescued at sea and processed in the territory of another country. This analysis of the Committee's views in this case explores various issues of maritime search and rescue responsibilities and the subsequent responsibilities for safeguarding human rights, including protection from refoulement.
