Abstract

This article outlines the enlightened steps and a wise approach of divorce provided in Islamic jurisprudence and what checks and restraints have been imposed by Islam and Muslim Family law in Pakistan over the exercise of the husband's power of ṭalāq. It also critically examines the ‘innovative triple divorce’ by whether it is sanctioned by Islamic law and its place within the Muslim family in Pakistan. Further it entails the stringent regulations of the Courts for this form of divorce and to state case law on and about it to portrait its effectiveness.
