Abstract

THXS paper looks at the strictly legal rules providing compensation for death and personal injury: the word ' l e g a l ' is used in the sense of the traditional rules applied by lawyers and the ordinary courts. The paper does not attempt to examine the many other types of compensation which may be payable under other types of rule or institution, e.g., sick pay, pensions, social security benefits, personal accident, life or sickness insurance, or criminal injuries compensation. Nor does this paper consider the question of legal compensation for sickness or congenital disability: there are in fact very few instances where legal rules imposing liability on other persons could lead to an award of damages in these cases.
