Abstract

The impetus for this legal development was set out in the first interim report on the examination in court. With the amendments made to date to the provisions on evidentiary law and substantiation of evidence, the legislature has only partially implemented the starting point formulated in the first interim report of rules of criminal procedure based on adversarial proceedings. This chapter, attention is devoted to possible reference points for legal development. For this purpose, it is important to give a brief description first of the starting points for the structuring of evidentiary law and substantiation of evidence referred to in the aforementioned sub-report. Next, the amendments made to the Code of Criminal Procedure on that basis are explained. The argument then focuses on ideas for further reform of the rules of evidentiary law and substantiation of criminal judgments.
