Abstract

The article is about the modern issues in the legal practice concerning protection of property rights, which is currently an urgent topic in legal science, since the importance of human rights and freedoms can hardly be overestimated. The author analyzes the current civil legislation, the existing arbitrage practice and the opinions of scientists considering this and related issues, after that formulates some theses for general understanding of this field. At the end of the study, the author comes to the conclusion that it is necessary to eliminate a number of gaps in the legislation on the protection of property rights.
