Abstract

ABSTRACT This paper examines existing and proposed national regimes—including the Federal Water Pollution Control Act and the proposed Superfund—for compensating persons suffering pollution damage. Also examined are existing public and private international regimes—including TOVALOP and the Fund Convention. In addition, the paper examines initiatives regarding pollution liability and compensation at the Third United Nations Conference on the Law of the Sea. Finally, drawing on the foregoing analysis, a comprehensive international liability and compensation regime is recommended for persons, both public and private, suffering pollution damage from oil or hazardous substances.
