The Innovative Development of Personality Right Legislation through the Law of Personality Rights in China's Civil Code

Abstract

Thanks to the experience in personality right legislation in the General Principles of the Civil Law as well as the lessons in personality right protection in judicial practice and the results of theoretical research into the law of personality rights, the law of personality rights in the civil code has achieved innovative development in the personality right legislation, which was reflected in eight aspects and would be discussed in detail thereafter. The legislative innovation in the law of personality rights in the civil code aims to create new ways of civil law legislation in the civil law system, guide society to respect personal dignity and protect personality rights, provide judicial basis for protecting personality rights of civil subjects and facilitate the theoretical development of the law of personal rights, thus promoting the unremitting progress in social civilization. That is how the continuous progress of social civilization can be promoted.
