The Improvement Direction of Compensation System by Restrictions for Public Use

Abstract

공용제한을 규정한 법률이 많지만 그에 대한 보상규정은 없거나 있더라도 미흡한 경우가 많다. 최근 장기미집행 도시ㆍ군계획시설 공원의 문제를 해소하고자 이를 도시자연공원구역으로 지정하여 계속 공용제한을 가하는 경우가 늘어나고 있다. 따라서 공용제한의 형식으로 공원을 관리하는 유사한 제도인 도시ㆍ군계획시설 공원, 도시자연공원구역, 자연공원에 대해 지정 및 관리, 보상의 측면에서 비교ㆍ분석하는 것이 시급한 실정이다. 본 논문은 공원 관련제도를 중심으로 공용제한에 대한 보상제도의 문제점을 분석하고 발전방안을 도출하였다. 연구결과 제시한 발전방안을 요약하면 다음과 같다. 첫째, 유사제도간 형평성 제고를 위해 실효제도의 보완, 매수청구제도의 개선, 조세감면의 일반화, 보상감정평가에 있어 공법상 제한의 동일한 처리 등을 제안하였다. 둘째, 공용제한의 특성을 반영한 권리구제를 위해 공용제한의 보상ㆍ지원에 관한 일반법의 제정, 공용제한의 유형별 보상ㆍ지원제도 검토를 제안하였다. 셋째, 권리구제의 강화를 위해 감가보상제도의 도입, 법원의 적극적인 보상청구 인용을 제안하였다.Although there are many laws with restrictions for public use, there are few compensation rules about them or insufficient. In order to solve the problems of long term unexecuted urban or gun planning facility parks, it has been increasingly designated as urban natural park zones. Therefore, it is urgent to compare and analyze urban or gun planning facilities parks, urban natural park zones, and natural parks, which are similar systems for managing parks in the form of restrictions for public use. The purpose of this study is to analyze the problems of the compensation system on restrictions for public use and to suggest improvement plans. The results of the study are summarized as follows. First, to improve equity between similar systems, it is needed to reform the invalidation system, to improve the system of purchase request, to generalize of tax reduction, and to treat in the same way on limitation of the public law in compensation appraisal. Second, to protect rights, reflecting the characteristics of restrictions for public use, it is needed to regulate a general law on the compensation of the restrictions for public use and to review the compensation system for each type of restrictions for public use. Third, to strengthen the protection of right, it is needed to adopt the depreciated compensation system and to be accepted the compensation request actively by the court.
