Abstract

Currently growing variety of criminal offenses, in particular organized crime with tough modus operandi revealed. Obstacles faced by the criminal justice system (SPP) in uncovering the crime, that obtaining the evidence in accordance with the Criminal Procedure Code. Government through UUPSK as the ratification of the UN Convention (UNCAC and UNTOC) governing the protection of witnesses and victims, including the provisions regarding whistleblower and justice collaborator. Whistleblower is a reporting criminal acts while justice collaborator is a witness who cooperated. The study aims to determine how the practice and implementation of SEMA No.4 of 2011 to provide legal protection for whistleblowers and justice collaborator. Research using normative juridical approach, specification of descriptive analysis, with a literature study research stage, and qualitative analysis of normative data. Reality legal protection of the whistleblower and the justice collaborator who arranged UUPSK been implemented according to regulations. However, because law enforcement also includes components of the SPP, then law enforcement will be in accordance subjectivity of each law enforcement agency. The obstacle of implementation SEMA No.4 of 2011 provides protection for whistleblowers is justice collaborator is the connective power of the SEMA is not strong, and will be an appeal to the judge, so the judge's decision will be different. In addition, SPP has policies and consideration of each in providing protection to the whistleblower and the justice collaborator.
