Abstract

The paper, co-authored by Marieke van Hooijdonk and Yves Herinckx on the occasion of a joint CEPANI/NAI colloquium on the theme “Do arbitral awards reveal the truth?”, discusses the impact on the search for the truth of the 2010 IBA Rules on the Taking of Evidence in International Arbitration and the 2013 IBA Guidelines on Party Representation in International Arbitration. The paper also reviews the recent Prague Rules on the Efficient Conduct of Proceedings in International Arbitration. The authors focus on counsel’s duty of candour and honesty and on the organisation of document production, witness testimony and expert input. They express their views on the – generally positive – contribution that the rules and guidelines on these matters provide to the finding of the truth in the arbitral process.
