Abstract
This paper analyzes the formation process and its uniqueness of trial management combining civil justice management and case management from the perspective of China's socialist ideology, court structure, litigation cooperation, litigation phase and technologies. Under the goal of judicatory for political service in China, judicial administration and case management are also closely integrated, so both dispute resolution and social control are equal. The setup of the special trial management agency, while controlling the quality and efficiency of trial, ignores the case management function, and weakening the independence of the judges. At the same time, civil case management in all stages of litigation and the development of information and communication technologies (ICT) have made great strides in China.
