Abstract

The Haitian Independence Debt has been a source of comment and controversy for nearly two decades. Haiti’s moral claim for restitution is doubted by no one, not even France. But the mechanics of restitution have long remained unclear. This paper attempts to supply a remedy. Through the form of a hypothetical memorandum to the government of Haiti, this paper explores Haiti’s legal claim for restitution of the Independence Debt within the French legal system. This paper analyzes issues of jurisdiction, state succession, contract law, and statutes of limitation. It concludes that Haiti possesses a plausible legal claim for restitution in France.
