Abstract

The al-Alama al-Hilly (d. 726AH) took great consideration into the origins of the hadiths of the Islamic laws in his jurisprudential encyclopedia (Muntaha al-Matlab fi Tahaqi al-Mathhab). He tried to lay out the touchstone of the correctness of a hadith by checking its origin which is one of the pillars of 'Ilm al-Dirayah'. Therefore, the al-Alama al-Hilly have rendered a great service by presenting the narrators as (Unknown, weak…etc.) He distinguished between the hadith that is accepted for its correct origin and the hadith that is accepted because it is acted upon regardless of its origin.
