Abstract

This article analyses how NAFTA significantly changed the Mexican energy market. The article begins with a general overview of NAFTA as an international agreement under the law of the three parties. Then, it covers the following: (1) general principles of the energy chapter, peculiarities on the negotiations with Mexico and general background on the Mexican energy industry; (2) impact by areas: trade, exploration and production, petrochemicals, refining, gas and electricity; (3) impact of NAFTA in government procurement—an area of paramount importance for energy in Mexico; and (4) protections granted by NAFTA's Investment Chapter to direct foreign investors and their effect on energy projects.
