Abstract

The gratuitous transfer of property has been a settled area of equity for many years, with different rules applying to personal property and land. However, the highly anticipated Supreme Court judgment of Petrodel v Prest appears to be at odds with the settled law relating to gratuitous transfers of land. The question asked, therefore, is whether or not Petrodel should be considered to have reformed the law relating to gratuitous transfers of land.
