THE FIQH OF MUHAMMAD BIN SHUJA’A AL-BAGHDADI IN PERSONAL STATUS AND TRANSACTIONS A COMPARATIVE STUDY

Abstract

Praise be to God, Lord of the Worlds, and prayers and peace be upon His faithful Messenger and upon all his family and companions. As for what follows: God  has bestowed upon us the nation of Muhammad ﷺ with many blessings, including the large number of jurists who did their best to know the ruling that God wanted  so they were the heirs of the prophets, which was required of his students. Science honors and honors them and prays for them and mentions their virtue, because they gave us a scientific legacy that enriched us with research and investigation in many sections of science, so I chose a scientific personality to be the focus of my scientific research for this year, and my choice fell on one of the flags of Hanafi jurisprudence and its advanced, he is the jurist Muhammad bin Shuja Al-Baghdadi (181-266 AH), and due to the large number of issues in which he said, I divided them into three studies, of which my share was his jurisprudence in personal status and transactions, so I named it (Jurisprudence of Muhammad bin Shuja al-Baghdadi in Personal Status and Transactions - a comparative jurisprudential study), and the study after his life included the following issues : 1. The sanctity of the wife's mother by contract or by consummation? 2. The death of the hunting before the ability to slaughter it. 3. Requirement of the condition option with the option of assignment. 4. Ladder in boneless meat. 5. The effect of singing on the justice of witnesses. 6. Referendum of the immoral jurist. 7. Take the sugar into the river. The research proved that he was nicknamed Balthaliji in relation to his great-grandfather Snow bin Omar Ibn Abd Manaf, and it was said that the nickname Balthaliji is the proportion of a locality in Baghdad where snow is sold, and the former is more likely, and that some of them call him Balkhi, which is inaccurate. The research also proved the scientific status of Muhammad bin Shuja’, may God have mercy on him, and some scholars resented him because he was accused of retiring, and perhaps this was at the beginning of his life, then he repented and repented.
