Abstract
The article discusses the recent European Free Trade Association (EFTA) Court’s judgment in case E-7/23 ExxonMobil Holding Norway AS which is yet another element in the final loss saga initially developed by the Court of Justice of the European Union (ECJ) in the Marks & Spencer case.
