Abstract

This Note evaluates the decision in Williams v University of Birmingham [2011] EWCA Civ 1242 which reiterated that, though mesothelioma claimants are assisted with proof of factual causation by the radical Fairchild doctrine, they must establish the other elements of the claim in negligence in the orthodox way.
