Abstract

The paper develops some preliminary considerations about the European legal expenses insurance market and, in the light of the emerging EU collective litigation, it introduces the case of the litigation buyout insurance, a policy that has been adopted under certain circumstances by corporate defendants and their insurers to afford the coverage for current or prospective mass litigation in the United States.
