Abstract
This chapter looks at various areas in which the Court of Justice has made its mark. First, there is the area of the interpretation and enforcement of existing Community legislation in the field of the environment. Second, insofar as the technical but important area of Community competence is concerned, the Court has recently delivered a landmark judgment whereby it held that, specifically in the field of the environment. Third, in the field of international law, the Court has made a number of ground breaking decisions which confirm the centrality of international environmental law obligations assumed by the Community. Fourth, the Court has permitted Member States to rely on the principle of environmental protection as a justification for departure from other fundamental Community law principles.
