Abstract

Since the EC Merger Regulation was adopted in 1989, merger control has become established as an important part of EC competition law so that today all major businesses and law firms are aware of the Commission's extensive powers in this field. Right from the beginning, the Regulation's scope has occupied a central role in many mergers taking place both inside and outside the European Community. The second edition of The European Commission's Jurisdiction to Scrutinise Mergers provides the most thorough examination of the Commission's jurisdiction to examine mergers under the Regulation. Even though the Merger Regulation provides a detailed account of what mergers fall within the Commission's jurisdiction--and irrespective of the large number of cases that have now been decided by the Commission--the delimitation of jurisdiction continues to create significant problems. The second edition of The European Commission's Jurisdiction to Scrutinise Mergers offers a comprehensive and up-to-date analysis of all aspects of this delimitation. It provides valuable guidance to businesses, their legal advisors and competition law enforcers in the Commission as well as in the Member States.
