Abstract

On 28 November 2022, the European Commission (‘Commission’) adopted two proposals to modernize the legislation on design protection, consisting of a proposal for a regulation amending the Community Designs Regulation [COM(2022)666] (‘Regulation’) and a proposal for a directive on the legal protection of designs [COM(2022)667] (‘Directive’).1 The Commission asked for feedback to be submitted by 31 January 2023. All feedback received will be summarized by the Commission and presented to the European Parliament and Council with the aim of feeding into the legislative debate. The Committee for Design Law of the German Association for the Protection of Intellectual Property (‘GRUR Committee’), consisting of design law experts from the academia, the judiciary, the legal profession and industry, submitted various detailed comments on both proposals. These comments, which included two helpful synopses and some more specific remarks, are addressed both at the Commission and to the German Government.2
