Abstract

During the review period, which covers January 2017—July 2018, six settlement decisions were adopted by the European Commission under the settlement procedure.1 Five of those decisions concerned automotive parts or systems2: Thermal Systems,3 Lighting Systems,4 Occupant Safety Systems,5 Spark Plugs,6 and Braking Systems.7 The sixth case concerned the intercontinental maritime transport of vehicles (Maritime Car Carriers).8 The adoption of these full settlement decisions (see Section III for an overview) thus brings the total of cases treated under the EU Cartel Settlement Procedure to 28. In the review period, the Commission further adopted a decision under the standard procedure against the non-settling party in the Trucks case.9 The Commission readopted a decision against Printeos,10 after the annulment by the General Court of the fine imposed on this settling party in the Envelopes case.11 The Commission substantiated in more detail the methodology it applied in the implementation of point 37 of the Guidelines on Fines12 in order to adjust the basic amount of the fine. The same fine of EUR 4 729 000 was re-imposed. The new decision is again under the scrutiny of the Court.13
