Abstract

This working paper prepared for a conference hosted by the Stanford University Hoover Institution's Program on Regulation and the Rule of Law offers critical analysis of the Supreme Court's decision in Department of Homeland Security v. Regents of the University of California and its implications for legal debates surrounding enforcement discretion.
