Abstract

This paper is based on a keynote address at the European Summer School, University of Rome at Sapienza, 2018. It encompasses Professor Alpa’s long line of research in comparative private law, dealing with the issue of fundamental rights in contract law. The essay provides an overview of the development of discussions and the treatment of such rights in a number of European Member States, and ultimately, the challenges these pose for the harmonization project of European contract law.
