Abstract
ABSTRACTThere is an apparent disconnect between the terminology used in heritage protection legislation on the one hand and that used in national heritage protection policy in the National Planning Policy Framework on the other. Nigel Hewitson explains how this disparate terminology came about, describes the correct approach to development management decisions involving heritage assets and provides a useful update on how the courts have approached the issues.
