Abstract

This research aims to review Cyber Pornography according to Law No. 19 of 2016 on Information and Electronic Transactions (ITE). This research is normative legal research, where the analysis of legal sources is carried out qualitatively and the overall results of the analysis of legal sources are presented descriptively, and fully explained about the problem. The results showed that, under Law No. 19 of 2016 on Electronic Information and Transactions (ITE), pornography is a criminal offence against the values of decency or decency that live in society by using computer means to perform its actions, by distributing and/ or, transmitting and / or making accessible electronic information and / or electronic documents that have a charge of violating decency by Intentionally and without rights. The vagueness of the elements of deeds, circumstances and consequences and the opening of interpretation, can be seen from the elements of Article 27 Paragraph (1) which does not contain in the general provisions and explained article by article what is meant by Electronic Document that has a charge that violates decency. It is not clear which is the core (standard), whether, distributing, transmitting, and/or making accessible and the Phrase of Decency in the Law on Information and Electronic Transactions generalizes the forms of Decency known in Chapter XIV of the Criminal Code, namely crimes against decency.
