Abstract

In Aguilar v. Felton, the Court broadly applied the Lemon test to strike down parochial school participation in a special education program in the New York City school system. The decision in Aguilar came under criticism as taking an overly separationist approach to the Establishment Clause and was overruled in Agostini v. Felton.
