Abstract

Abstract The foregoing chapter has argued that the trust cannot, but the contract can, explain the tripartite relationships found in the unit trust; that the unit trust has its genesis in the contract; and that the trust is simply part of the contract creating the unit trust. The conclusions that follow must be that the parties’ rights and liabilities fall primarily within the domain of contract law and that, insofar as a trust relationship has been created by the unit trust contract between particular parties, trust law also operates.
