The Challenge of the Criminal Law in the Fourth Industrial Revolution

Abstract

최근 우리사회는 정보화 사회를 넘어서서 제4차 산업혁명을 통한 제4의 물결이 거세게 밀려오고 있다. 제4차 산업혁명은 인공지능과 로봇, 사물인터넷 등 새로운 첨단기술로 무장을 하며 현행 형법체계 자체를 근본부터 새롭게 구성해야 하는 ‘게임 체인저(Game Changer)’가 되고 있다. 인간이라는 불변의 기반위에 세운 형법체계가 인공지능 로봇의 등장으로 인해 흔들릴 수 있기 때문이다. 물론 그와 같은 추측이 필자의 ‘공상’이라고 할 수도 있을 것이다. 하지만 제4차 산업혁명에 적응하고 있는 우리 사회의 모습이나 산업계의 동향, EU, 미국, 일본 등 주요 선진국들의 여러 움직임들을 살펴볼 때 필자의 주장이 단순히 공상이라고는 할 수 없을 것 같다. 바로 가까운 미래에 우리 형법이 당면한 현실인 것이다. 그러므로 본 논문에서는 형법에 영향을 미칠 수 있는 인공지능, 로봇, 자율주행 자동차 기술에 대한 기술에 대해 대략적으로 살펴보았다. 그리고 그와 같은 기술이 형법에 미칠 수 있는 영향이 여러 가지가 있지만, 최근 세계적인 상황을 고려해서 현행 우리 형법에서 고려해 보아야할 도전과제를 세 가지로 나누어 보았다. 하나는 인간 중심의 행위론에서 인공지능 로봇이 함께 고려될 수 있는 가능성이다. 이미 일부 국가에서 인공지능 로봇은 사람과 같은 취급을 받고 있기 때문이다. 또 다른 하나는 강한 인공지능 로봇의 경우 형법적 책임성을 물어야 하는 상황이 올 수도 있다는 것이다. 다만, 현행 책임론과 같이 구체적인 책임을 규명하기 보다는 책임조각사유를 고려해야 할 수 있다. 이는 먼 미래의 이야기 같지만 이미 주요 선진국들은 유사한 논의를 하고 있다. 마지막으로 자율주행자동차는 이미 상당히 대중화되어 있다. 여기서 형법상 문제가 될 수 있는 것이 현행 과실범처벌 구조라고 할 수 있다. 따라서 일부 과실행위는 제조물책임법으로 해결해야 하는 경우가 증가할 것이며, 일부 과실행위는 과실범이 아닌 고의범으로 해결해야 할 수도 있을 것이다. 본 논문에서는 눈앞으로 다가온 4차 산업혁명이 형법에 어떤 도전과제를 줄 수 있을지에 대해 아이디어 차원에서 몇몇 쟁점을 제시해 보았다. 주요 선진국들은 이미 4차 산업혁명과 관련된 법적인 문제들을 다양한 측면에서 검토하고 있다. 그에 반해 우리나라는 아직 출발선도 넘어서지 못하고 있다. 그러므로 우리도 이제부터라도 4차 산업혁명이 초래할 형법적인 문제점들에 대해 머리를 맞대고 고 찰해 보아야 할 것이다.Recently, our society has been flooded with the fourth wave through the Fourth Industrial Revolution. The Fourth Industrial Revolution consists of new advanced technologies such as A.I., robot, and IoT. Therefore, it is becoming a ‘Game changer’for the current criminal justice system. That is because the criminal system built on the foundation of the human rights system can be shaken by the advent of artificial intelligence and robot. Of course, such supposition may be called my ‘fantasy’. But, given the issues discussed in the major developed countries such as the EU, the United States and Japan, and industrial trends, my argument cannot simply be called fantasy. In the immediate future, the criminal justice system will face the reality. Therefore, this article briefly examined the technique of artificial intelligence, robot, and autonomous vehicle technologies that could affect the criminal justice system. And we looked at the challenges of the criminal justice system in the three sectors - crime of A.I. Robot, criminal liability and criminal negligence. As a result, we conclude that the change in our criminal justice system is a necessity. Major industrial nations are already reviewing legal issues related to the Fourth Industrial Revolution. On the contrary, we have yet to reach a starting point. The criminal law academic society is hesitant to deal with such issues. We will have to review the criminal problems that the fourth industrial revolution will bring forth.
