If the defamatory action took place online there is no physical location to establish jurisdiction. Another problem with online defamation is the difficulty in determining who made the defamatory statement. Most defamation cases are filed in the jurisdiction in which the plaintiff resides This is the jurisdiction whose laws will be applied in evaluating whether the defendant committed a compensable act of defamation
