Abstract

This chapter examines the Board of Appeal (BoA) of the European Chemicals Agency (ECHA). It presents the legal framework for its activities and its role in shaping EU chemicals law, assessing how it adopts its decisions and exercises its powers. Moreover, it discusses the standard of review exercised by the ECHA BoA and its relationship with the CJEU, reflecting on recent developments which appear to cast a shadow over the actual realization of the full potential of the ECHA BoA as an expertise-based adjudicatory mechanism and, consequently, on its added value in comparison to a review exercised directly by the Court.
