Abstract

This chapter analyzes the nature and scope of legal regulation. This is not in the nature of a complete treatise on the law relating to discretionary powers; rather the point is to identify some of the central issues with a view to seeing how they have been handled by legislatures and courts. The legal framework within which discretionary powers occur is considered, and then the basis of judicial review is analysed in terms of constitutional doctrines and values.
