Abstract

This survey covers European Commission decisions and policy files as well as judgements of the EU courts in transport cases between January 2019 and January 2020. In 2019, the Commission continued investigating several transport-related antitrust cases. Several judgements and decisions were adopted in 2019 relating to procedural aspects of these investigations. In 2019, the Commission continued its evaluation of the consortia block exemption regulation (CBER) proposing to prolong it by four years. With respect to mergers the Commission approved unconditionally the acquisition by Air France/KLM of joint control over Virgin Atlantic. It also approved with conditions the acquisition of UK regional air carrier Flybe by Connect Airways, a consortium by Virgin Atlantic, Stobart Aviation and Cyrus. The Court of Justice confirmed the judgement of the General Court annulling the Commission’s 2012 prohibition decision in the UPS/TNT case.
