Under the background of the global COVID-19 pandemic, electronic informed consent (eConsent) utilizes technology to provide a new method and idea for clinical trials. It has the advantages of convenience and efficiency, which greatly improves the efficiency of clinical trials. At present, this concept has not been put forward in China while it has been clarified clearly abroad, and some countries have launched a variety of trials and formulated various regulations to further standardize the eConsent. Based on the current situation of eConsent in China, this study analyzed the design and implementation of eConsent, summarized relevant domestic and foreign laws and regulations, and proposed opportunities and challenges for electronic informed consent as well as the relevant preparations for the implementation of this technology in China. © 2021 West China University of Medical Science. Venezuela: Finding Foreign Law in Venezuela. General Overview

In Venezuela, foreign law is determined and applied ex officio. This is the rule contained in international treaties in force (i.e., Bustamante Code and in Inter American treaties) and in domestic law. In practice, however, parties do much of the work. Courts and litigants research foreign law on the Internet, but courts are not bound by their findings or the parties’ submissions on foreign law. Affidavits on foreign law are also common practice. The incorrect application of foreign law is subject to appeal even before the Supreme Court of Justice. There is no reported experience of courts or parties requesting international cooperation for obtaining information on foreign law. Costs incurred in finding foreign law are to be borne by the interested party, with the expectation of recovery of judicial costs if successful in litigation. Costs incurred by the courts in such a process are not borne by the litigants. Venezuelan courts are now more aware of their duties when applying foreign law and this is likely to lead to a more effective ways of finding foreign law.

International and Foreign Law in Domestic Constitutional Law

This chapter illustrates the role of international and foreign law in domestic constitutional law. Through the case analysis of South Africa (a post conflict state) and the United States (often seen as a country that is not too friendly to international and foreign legal systems), it discusses the role of international and foreign law in reconciling the regional development of the rule of law in a country, by working closely together with domestic constitutional law. The domestic courts both in the United States and South Africa, whenever they deem it appropriate, do consider international and foreign law in the resolution of disputes before them. The conditions under which each jurisdiction may resort to foreign or international law, as well as the criteria used for taking them into consideration, vary. However, most importantly, this practice should be encouraged as it promotes the uniform interpretation of international law and the progressive advancement of norms world-wide, which are aspects that are especially important in the field of human rights.

Japan: Proof of and Information About Foreign Law in Japan

According to Japa3nese theory and practice, the application of conflict of laws rules is regarded as mandatory. Once designated by the conflict of laws rules, foreign law ought to be applied by the domestic courts in the same manner as is domestic law. Foreign law is considered “law” and the judicial authorities have a duty to apply it ex officio. Judges are obliged to interpret and apply governing foreign law in the same manner as judges in the country of origin do. If the content of applicable foreign law cannot be ascertained, the recent literature and the court practice supports the application of lex fori. The misapplication of the designated foreign law constitutes grounds for an appeal to the Supreme Court.

A Study on the Trade Expansion Plans of the Cosmetic Ingredients Industry: A Comparison of Domestic and Foreign Laws

Purpose Along with the growth of the cosmetics market, consumers’ demand for organic and eco-friendly materials is increasing, further emphasizing the importance of cosmetics materials. However, most of Korea’s cosmetics ingredients depend on overseas imports from China, Japan, and the United States, acting as a limiting factor for the continued growth of the domestic cosmetics industry. Despite the strengthening of regulations on the import and export of cosmetics materials worldwide, it is not specifically specified in the domestic enforcement ordinance or enforcement regulations, this paper would like to summarize countermeasures for this. Design/Methodology/Approach In this paper, after reviewing domestic cosmetics-related laws and administrative rules, the European Union’s new chemical system was analyzed, and related laws in China were examined. In addition, in accordance with the main contents of the Nagoya Protocol, the problems that raw material companies should urgently deal with were examined, and the government’s countermeasures necessary for this were summarized. Findings As a result, In order for K-cosmetics to challenge the global market, it is necessary to meet international regulatory standards from the development stage, and government help to quickly provide information on changing laws and regulations related to the cosmetics raw material industry is urgently needed. Research Implications In addition, this paper will help predict and prepare risk variables in advance by analyzing domestic laws and national laws related to import of raw materials for overseas cosmetics.

A Comparative Foreign Relations Law Agenda: Opportunities and Challenges

International law is generally understood to be made up of the rules that states accept as binding in their relations with one another. But international law is the product not only of a political and legal process that takes place between states — as this common understanding implies — but also of processes that take place within them. And yet to date there has been remarkably little cross-national work examining the role of domestic politics and law in the creation of treaties and other international law. Part of the reason for this gap is the difficulty of conducting cross-national studies of foreign relations law on a large scale. To the extent there have been comparative studies done of foreign relations law, they have been largely limited to relatively small-scale case studies. More comprehensive examination of the differences across nations in the ways in which they make international commitments is rare. This chapter aims to contribute to an emerging conversation about how best to carry out a more comprehensive examination of differences between states in the law governing their engagement in the world around them. It maps out five areas that offer opportunities and challenges for the study of comparative foreign relations law. First, the choice of methodology, whether quantitative or qualitative. Second, the under-representation of certain states in existing foreign relations scholarship. Third, the domestic political and institutional structures that shape the interplay between the legislative, executive, and judicial functions within states. Fourth, the role of geopolitics. Fifth, the chapter sounds a cautionary note about approaching international law through domestic law.

The problem of the substance of the applied foreign law, viewed from the point of view of the law of the adjudicating court and thus defining the relation between the applied foreign law and the domestic law on the basis of the conflict rule of the forum, may be briefly and simply described as antinomy between the thesis that “foreign law is a fact from the viewpoint of the adjudicating court” and the thesis asserting that “foreign law is a law also from the viewpoint of the adjudicating court”. As we shall further see, there is a whole range of opinions striving for a compromise between these two extremes.

This study examined the domestic and foreign laws and guidelines about the evacuation map, and investigated and analyzed the present state of the domestic evacuation map. Based on this analysis, this study considered problems of the evacuation map and suggested the necessity of standardizing the evacuation map. The study results are as follows. First, the positions of the emergency exits and evacuation routes are indicated, and the positions of fire-fighting facilities and operations methods and evacuation and coping methods are provided in the domestic law about the evacuation map, but there was a lack of guideline needed for drawing up the evacuation map. Second, when investigating the cases of the U.S.A. where makes it compulsory to install the fire evacuation map and suggests guidelines written by each state, there were differences in the written items of the evacuation map, but commonly, more detailed contents are provided than in korea. Besides, they provided the template or example map to unify the style of the evacuation map of each state. Third, domestic evacuations map were drawn up by specialized companies and individual businesses, or by business owners. Fourth, the present position, floors, explanatory notes, the name of business, number for notification and title(evacuation map) are written except the items provided in the domestic law, and each case has a different way of indicating or they are omitted. In addition, there were various problems including different ways of writing in the map. Finally, when analyzing the evacuation map, based on sign's components, there was no fixed form of layout, and readability of words and visibility of colors were low, and signs and pictograms used in each case lacked unity, which means there were a lot of problems that might cause confusion in the emergency situation.

Foreign Law, Democracy, and Constitutional Interpretation: A German-American Comparison

Democracy is usually relied upon as an important argument against the excessive influence of international and foreign law on the domestic legal order, and especially on domestic constitutional law. Both in Germany and the United States, skeptics and opponents of the Europeanization or internationalization of domestic constitutional law repeatedly raise democratic concerns. From a comparative perspective, this Article examines the German and American democratic arguments against an overreliance on international and foreign law in constitutional interpretations. In exploring the democratic concerns expressed in German and American discussions, this Article focuses especially on the contrast between German dualism on the one hand and American exceptionalism on the other hand. This Article shows that, while the German dualists and the American exceptionalists base their arguments on different understandings of democracy, they share the viewpoint that democracy can only be realized on the national level, whereas international law aims at uniformity und thus inevitably runs counter to democratic self-governance and self-determination of the states. Precisely in this sense, it can be said that there is no qualitative, but rather only a quantitative distinction between German and American democratic arguments. Thus conceived, the alleged contrast between the principle of open statehood emphasized by German constitutional law scholars and the Constitutional Court and the idea of American exceptionalism embraced by a number of critics of the use of foreign law lies only in the extent to which the reference to international or foreign law in interpreting the domestic Constitution is deemed legitimate and justifiable.

The Significance of the Principle of Equality in the Conflict of Laws

It is relatively easy to determine the significance of the postulate that the substantive laws of the various states which are made applicable by the forum's choiceof-law rules have to receive equal treatment. One way to achieve this is to establish the same criteria for the applicability of foreign and domestic law, e.g., by uniformly subjecting succession to the law of the nationality or the domicile of the decedent, or to the lex rei sitae. This treatment of the lex fori and of foreign legal systems on the basis of parity' is generally the product of so-called multilateral choice-of-law rules. The same result can, however, be achieved by delimiting the applicability of the lex fori by a unilateral choice-of-law rule and leaving the regulation of the applicability of foreign substantive law to foreign choice-of-law rules in such a manner that the interplay of the domestic and the foreign rules results in parity of treatment for the foreign and domestic legal orders.2 Unequal consideration of foreign and domestic law is usually the result of a more extensive application of the lex fori. This is almost invariably the case where the foreign substantive law rules that are normally applicable are excluded from application on grounds of public policy, and where the gap thus created is filled by domestic law. Inequality also results, obviously, where foreign law is applicable only if connecting factor A is present and B is not, while the lex fori applies in the presence of either factor A or factor B. An example of this would be the application of the forum's substantive law of succession to the estates of all decedents who are nationals of the forum state, and of the lex domicilii to the estates of all non-nationals:3 Foreign law would then only be applicable to the estates of aliens domiciled abroad. Analysis of Domestic and Foreign Standards and Conditions for the Prevention of Fire through Ducts

Ducts penetrating the fire compartment are passageways for spreading the flames and smoke of igniting deposits attached to the inside or fires from outside. Fires through ducts have a fast flame propagation speed and are difficult to extinguish quickly because of the high-temperature heat. Therefore, in this study, to improve the fire risk of ducts, the need for institutional improvement is confirmed by analyzing fire cases, comparing domestic and foreign laws and standards, and analyzing the current situation. As a result, a blind spot is evident in domestic law at the location of the fire damper installation because of the mitigating condition of fire compartments. There is also a gap regarding the need to prepare preventive systems such as maintenance standards inside ducts and installation standards for fire suppression systems in commercial restaurant kitchens.

This study looked at relevant STCW, STCW-F conventions, domestic regulations and status of other countries to present necessity and development direction of training record book for fishing vessel officers in Korea. As a result of the study, it is required by STCW, STCW-F conventions and domestic laws. However, there are no examples of the development and application of training record book for fishing vessel officers. Since Korea completes designated education institution and obtains a license, systematic education completion and verification are essential. It should be to it consideration of the contents of IMO Model Course 7.06, the standard for training of fishing vessel officers, as well as domestic laws and regulations and training conditions. The development of training record book is expected to contribute to the improvement of the value of licenses and the development of industries as well as the strengthening of maritime capacity.

Foreign Law as Legislative Fact in Constitutional Cases

Do we really need another law review article about foreign law in constitutional interpretation? In fact we do. In the vast literature on the subject, a fundamental point has received scant attention. In the recent rulings that have stoked the present controversy, the Supreme Court has employed foreign law not as law, but rather merely as evidence of a legislative fact made relevant by domestic constitutional law. Commentators, however, have largely directed their attention to the merits of a genuine constitutional comparativism, in which foreign law serves as a model for the creation of domestic constitutional doctrine. Many commentators have advocated just such an approach, and at least one sitting Justice has joined in this chorus in both extrajudicial commentary and in a dissenting opinion. But to date, the Court has yet to take this much-mooted step, perhaps due to an awareness of the complex theoretical challenges such an approach would raise. A few opponents to the Court’s actual practice have forcefully observed that the Court’s use of foreign law has lacked the rigor and impartiality that would be necessary to make it credible. What even these scholars have not done, and what this essay ventures, is to consider these claims within the broader context of the Court’s use, and misuse, of all manner of evidence employed in connection with questions of legislative fact in constitutional adjudication.

In the production of virus vaccines, human diploid cells are more advantageous over primary cells in terms of avoiding exogenous contamination, poor stability, and inconsistent antigenicity. Diploid cells can also be used to build cell seed bank system and are more suitable for quality control. Human diploid cell strains currently commonly used as cell matrix include MRC-5, 2BS, KMB-17, WI-38, and SV-1. This review summarizes the requirements and quality evaluation of human diploid cell strains from domestic and foreign laws and regulations to promote the construction and application of human diploid cell strains.
