Abstract

Discusses how the entry into force of the Antisocial Behaviour etc. (Scotland) Act 2004 has shifted primary responsibility for dealing with troubled children and young people from children's hearings to the courts, and considers whether this change accords with the principles of the United Nations Convention on the Rights of the Child 1989. Examines whether the Scottish Executive youth justice agenda is likely to result in further differential treatment of children.
