Abstract

In this paper, I consider how the Supreme Court of Canada has used the concept of comity in its Charter jurisprudence, focusing primarily on s.7. I argue that the effect of its adoption of public international law principles has been to limit the rights of Canadians and create zones free from Charter rights or court scrutiny.
