Abstract
Abstract This chapter focuses on Article 349 of the Treaty on the Functioning of the European Union (TFEU). Article 349 TFEU established the essential details on the Outermost Regions (ORs) regime established by Article 355(1) TFEU. According to the provision, the EU legislature may adopt specific measures aimed at laying down the conditions of application of the Treaty to the regions within the article. The chapter enumerates the closed list of territories where the special regime is established by Article 349 TFEU. It clarifies that the derogations under Article 349 TFEU cannot be permanent but are not exactly exempt from the main principles of EU law governing the employment of derogations.
