Abstract

Abstract This chapter addresses Article 19 of the Treaty on European Union (TEU), which deals with the Court of Justice of the European Union (CJEU). As stated in Article 19(1) TEU, the CJEU includes the Court of Justice (ECJ), the General Court (GC), and specialized courts. The term ‘Court of Justice’ thus denotes both the entire system of Union courts and the ECJ as the highest of those courts. The CJEU fulfils different functions in the EU judicial system. It acts as a constitutional court when it rules on disputes between the institutions or between the institutions and the Member States on the scope of the powers of the Union and its institutions or on the extent of the duties of the MS that flow from the Treaties. It also acts as an administrative court when it controls the legality of non-legislative action on the part of the institutions. In addition, the Court is tasked to ensure the uniform application of Union law. The chapter then looks at Article 19(3) TEU, which contains a summary of the grounds of jurisdiction of the Union courts.
