Abstract

Editor's note: A number of states are considering (and some have already passed) legislation to “fix” their eminent domain statutes in response to Kelo v. City of New London. On October 18, Patricia Salkin, Associate Dean & Director of the Government Law Center of Albany Law School, provided testimony on this issue to the New York State Senate (Committee on Commerce, Economic Development and Small Business as well as the Committee on Local Government). Excerpts of her comments are reprinted below because they may be relevant to other state legislatures considering eminent domain reforms. Dean Salkin may be contacted directly at Psalk@mail.als.edu.
