Abstract
Human rights are the natural rights that exist in man since man was created by God Almighty. The right of everyone can not be implemented freely, because he is face to face and must respect the rights of others. Human rights are composed of the two most fundamental rights, namely equal rights and freedoms. The Communist Party of Indonesia (PKI) is listed as the largest Communist Party.. After the September 30th Movement there has been a killing that killed millions of both sympathetic and affiliated members of the PKI. The approach method used in this research is normative juridical, that is prioritizing library research to obtain library materials as basic data, supported by field research. According to the nature of this research is Descriptive Analytical research, which is focused on collecting data collection or classify. Data collection techniques to be used in this study are document studies to collect secondary data and drawing conclusions from the results of research that has been collected done by qualitative analysis methods. Research conclusion That the state is responsible for the occurrence of such cases by violating the provisions of international provisions, the responsibility of the state can be seen in UDHR 1948, (ICCPR) 1966, ICESCR) 1966 and has violated the state's rights and obligations (Draft Declaration on Rights and Duties of States) emphasized in article 6.
