Abstract

In Japanese legal context, drug addicts are treated as criminals even if they have no experiences to distribute drugs. They might be filed their cases and got convicted, and be incarcerated. In prison they might have chance to participate in sessions of cognitive behavioral therapy. However, in legal system they are treated as criminals but drug addicts. Many countries have been introduced the concept of harm reduction or harm minimization against drug problems. In this context, they are treated as drug addicts but criminals. Criminal justice system should play a main role to keep our society's security and safety. Unfortunately, the system in Japan is more moral-friendly and it tend to ignore what reality is. The realities for drug addicts are that they have been use drugs because of survival of their lives. This implies that drug use might be a sigh for needs for some help. Criminal justice system should take it seriously and it should start to rebuild the better system for prevent further ‘harm’ to society. In this session I will propose better scenario to promote harmless society in Japan.
